These Terms of Service govern your use of beawart.com and any purchase you make from us. By using this site or placing an order, you agree to them.
1. Who we are

âWeâ, âusâ and âourâ mean BEAWART LLC. âYouâ means the person using this site or placing an order.
2. Using this store
You must be at least the age of majority where you live, or have the consent of a parent or guardian, to place an order. You may not use this site for any unlawful purpose, transmit malicious code, or attempt to interfere with its operation. A breach of these terms ends your right to use the site.
3. Our products
We sell printed educational and wellbeing posters for classrooms, nurseries and homes. Product dimensions, materials and finishes are stated on each product page.
Colours shown on screen depend on your display and printer calibration, and printed colours may vary slightly from what you see. Slight variation in trimming is normal on printed goods.
We may change or discontinue a product at any time, and may limit the quantity of any order.
4. Orders, acceptance and pricing
Your order is an offer to buy. A confirmation email acknowledges that we received it; it does not conclude a contract. The contract is formed when we dispatch your order.
We may refuse or cancel any order at our discretion, including where an item was listed at an incorrect price or where we suspect fraud. If we cancel an order you have already paid for, we refund you in full.
All prices are in US dollars (USD) and exclude sales tax, which is calculated at checkout. Prices may change without notice.
5. Payment
You confirm that you are authorised to use the payment method you provide and that the information you give is true and complete. Payment is taken at checkout. Payments are processed by Shopify and its payment providers; we do not store your full card details.
6. Shipping, delivery and risk
We ship within the United States only. Orders are dispatched from our warehouse in Springdale, Arkansas, or from an Amazon fulfilment centre, so your parcel may arrive in Amazon packaging.
Delivery estimates are based on our own records and are not guarantees. We are not liable for delays caused by carriers, weather or other events outside our reasonable control.
Risk in the goods passes to you on delivery to the address given at checkout. Once a carrier records a parcel as delivered to that address, we are not responsible for it being stolen or moved.

7. Returns and refunds
You have 30 days from delivery to request a return, subject to the conditions in our Return & Refund Policy, which forms part of these terms. Return shipping is paid by you except where an item arrives damaged or defective, or where we sent the wrong item.
Nothing in these terms limits any statutory right you have that cannot be excluded by law.
8. Intellectual property
All poster artwork, illustrations, text, photography, logos and site design are owned by us or licensed to us, and are protected by copyright and trademark law.
When you buy a poster you own that physical copy, for personal or classroom display. You do not acquire any right in the artwork itself. You may not scan, reproduce, redistribute, resell, sublicense or create derivative works from our designs, or use them for commercial printing, without our written permission.
9. Accuracy of information on this site
We work to keep this site accurate, but it may occasionally contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions or availability. We may correct any error and update information at any time without prior notice, including after you have submitted an order. Where an error affects an order you have paid for, we will contact you and offer you the choice of continuing or receiving a full refund.
10. Reviews and submissions
If you submit a review, photograph or comment, you confirm it is your own, is accurate, and does not infringe anyoneâs rights. You grant us a non-exclusive, royalty-free licence to display and reproduce it in connection with our store. We may edit or remove any submission that is unlawful, abusive, or misleading.
11. Third-party links and tools
This site may link to third-party services, including carrier tracking pages. We do not control those services and are not liable for any loss arising from your use of them.
12. Disclaimer of warranties; limitation of liability
We do not guarantee that your use of this site will be uninterrupted, timely, secure or error-free. Except as stated in these terms or in our Return & Refund Policy, the site and our products are provided âas isâ.
To the fullest extent permitted by law, our total liability for any claim arising out of or connected with an order is limited to the amount you paid for that order. We are not liable for indirect, incidental, special or consequential losses.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities; where that is the case, our liability is limited to the maximum extent permitted by the law that applies to you.
13. Indemnification
You agree to indemnify and hold harmless BEAWART LLC and its officers, employees and suppliers from any claim or demand, including reasonable legal fees, arising out of your breach of these terms.
14. Termination
These terms remain in effect unless terminated by you or by us. You may terminate by ceasing to use the site. We may terminate at any time, without notice, if you breach these terms, and you remain liable for any amounts owed up to that date.
15. Severability and entire agreement
If any provision of these terms is found unlawful or unenforceable, that provision is severed and the remaining provisions continue in force.
These terms, together with our Shipping Policy, Return & Refund Policy and Privacy Policy, form the entire agreement between you and us. Our failure to enforce any provision is not a waiver of it.
16. Governing law
These terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict of law provisions. The courts of Sheridan County, Wyoming shall have jurisdiction over any dispute. This does not deprive you of the protection of any mandatory consumer law of the state in which you live.
17. Resolving a problem
If something has gone wrong with your order, please email us before taking any other step. We reply within one business day and would much rather fix it directly. A bank dispute takes several weeks longer to settle, and we cannot reship or refund an order while a dispute is open on it.
18. Changes to these terms
We may update these terms at any time by posting a revised version on this page. The version in force when you place an order is the version that applies to that order.
